These General Terms and Conditions apply to package holiday sale contracts for stays on the island of Ischia, organised by Organizzazione Sunlux Viaggi della Ischia Hotels Broker S.r.l. (hereinafter "the Organiser"), in accordance with Legislative Decree 79/2011 (Italian Tourism Code) as amended.
The contract is not concluded through an online purchase: the traveller sends a request (via the website form, WhatsApp or telephone) indicating the period, number of people and property or service of interest. The Organiser responds with a written quote containing the real price per person, the meal plan, the period, the financial terms and the offer's validity deadline.
The contract is considered concluded only upon the traveller's explicit acceptance of the quote, in the manner indicated in the quote itself. No payment by card or other online means is provided on the website.
Upon confirmation of the quote, a deposit of 30% of the total package price is required. The remaining balance of 70% is due 30 days before the departure date. For bookings made less than 30 days before departure, the full amount is required upon confirmation.
Payment methods (bank transfer or another agreed method) are indicated in the quote. No payment by credit card or other online means is provided on the website.
Under art. 41 of the Italian Tourism Code, the traveller may withdraw from the contract at any time before the start of the package, giving written notice to the Organiser. Exercising the right of withdrawal entails payment of the following penalties, calculated on the total package price and based on the date the withdrawal notice is received relative to the departure date:
The traveller also has the right to withdraw without penalty, as provided by law, in the event of unavoidable and extraordinary circumstances occurring at the destination or its immediate vicinity that significantly affect the performance of the package or the transport of passengers to the destination.
Any significant changes to the terms of the accepted quote will be communicated in writing to the traveller, who may accept them or withdraw without penalty within a reasonable period indicated in the communication itself, as provided by articles 39-40 of the Italian Tourism Code.
The Organiser is liable for the performance of the tourist services included in the package as provided by articles 42-46 of the Italian Tourism Code, subject to legal limitations and the coverage provided by the public liability policy indicated in art. 1.
In the event of insolvency or bankruptcy of the Organiser, the traveller is protected by the Fondo Vacanze Felici guarantee fund (registration no. 1065), as provided by the Italian Tourism Code to protect travellers in the event of the organiser's insolvency.
Any discrepancies in the performance of services can be reported during the stay via the assigned WhatsApp channel or by phone, for prompt action. Formal complaints after returning home must be sent to caldoglaciale@sunluxviaggi.com within 10 days of the return date.
The processing of personal data provided when requesting and booking is governed by the Privacy Policy.
This contract is governed by Italian law. For any dispute, where the traveller is a consumer, the court of the consumer's place of residence or domicile has exclusive jurisdiction, pursuant to art. 33, paragraph 2, letter u) of the Italian Consumer Code (Legislative Decree 206/2005), as a mandatory provision protecting consumers.
We reserve the right to update these General Terms and Conditions in the event of regulatory changes. Changes will be published on this page with the date of last update and apply to contracts concluded after publication.
